I think it depends on the nature of the fan work as well. Sure, you may love to have your characters name-checked or have people create fan art for the publicity, but what if someone put the Cute Knight in a porn game, or drew a picture of her being raped or beheaded? You'd probably quickly reverse yourself on being thrilled.
Like I said, 'how would you feel' can be a dangerous question. This is *me*, I came up anime through the hentai side of the fandom, the things that would bother me are not necessarily the things that would bother other people. :)

Hentai fanart is an interesting case, as I wouldn't feel comfortable giving anyone official permission but I would generally be happy to pretend I didn't know about it as long as it wasn't for profit, even if it was something icky. I have seen people write porny fanfics of my characters (not often though) and was amused by them.

In general I don't care as long as it's non-profit but there are things I can't put an official stamp of approval on, if you see what I mean.

Okay, this is what I got from my twitter today.

Seems what happened is
1. Someone that said he/she is from disney, emailed nanashi and asked him to pay 78000 USD because he beheaded mickey inside his game.
2. nanashi tried to contact him and give his phone number to the email sender to discuss this.
3. The email sender won't hear him and keeps asking him to pay, and nanashi's stressed.
4. Foreign forum said that it's strange since disney never did such thing before. They're asking if it's really from disney.
5. nanashi tried and managed to contact disney official staff, and they said that they did nothing regarding to nanashi's case.
6. nanashi concluded that it's a fraud email, but he has no intention to continue the game for the time being. Therefore the official site is remain closed.

What a horrible thing to do to someone! I'm absolutely appalled! Still, I am very happy for nanashi that they seemed to dodge the bullet. I hope that the production team will consider using that sort of thing more lightly in the future since I think nobody here was really surprised with the lawsuit to begin with.

If they do indeed end up finishing the game, I hope that in the end this will help their sales with all of the publicity they "gained." It really blows my mind that someone could be so... so... awful for a cheap prank :(

But with Nanashi contacted Disney official, who knows if (the real) Disney now turn their attention to this... who knows?

Heh, I knew it. My April Fool radar just went off when I first heard it. >__>' Well, at least it taught us a lesson to be more careful with copyrighted characters.

Yeah, I'm glad Nanashi isn't really being sued. But I hope the lesson we learned from all this is "DO NOT use copyrighted characters".

Interesting story. And it's good to hear it was fake..

But it didn't seem unbelievable though. These big companies can be very litigious. Although the fact that he didn't get a cease and desist-type letter first should have seemed suspicious.

Especially in Disney's case, it is very easy to assume it is truth (like the link to them suing a school for using characters on their walls). I'm glad it was fake in the end but that was rather jarring and scary when we believed it to be true.

They received the notice by e-mail? Where I live, legal notices of this sort are sent via registered mail, or served in person. I also don't see Disney asking for only $78,000. In the Air Pirates Funnies copyright infringement lawsuit, the preliminary judgment (1975) awarded Disney $200,000

Somehow, I didn't expect it to be false. Well, I'm really happy it is! I would feel really bad for Nanashi if that happened, although I guess this just shows you shouldn't used trademarked material in your games, this must have scared the s*** out of her/him.....

For me from the beggining even though it was about copyright stuff, I thought it was weird he was getting sued like that. I mean Disney sued before but this was just some freeware (?) Doujin person... not worth the legal action IMO

Scared him enough he's quit making the game, shut down the site, and says he plans to take a break from the internet as a whole for a while.

That's what made it so scary. Disney HAS gone after very small fish before with lawsuits, like daycares and street vendors. So something like this wasn't terribly unbelievable.

Apparently Nanashi had insulted some Disney fans on a forum, so they decided to scare the living daylights out of him by faking action on Disney's part. He apologized and said he shouldn't have picked a fight with them, but he still had to contact the real Disney company to find out the lawsuit was fake, so that has put him on Disney's radar. He's probably nervous that they'll sue him for real now that they now about the game, which is probably why he yanked the game and shut everything down to spend some time in the real world.

Still, remember that none of this would have worked to trick him if he hadn't been using someone else's copyrighted character.

For the record, this is how I feel. Apparently Andrew Hussie (Homestuck, Problem Sleuth) and the staff of Penny Arcade feel similarly.

I do a LOT of references to other Ren'Py games, but I've always asked permission for it, so...
