I'd rather have the people that wrote the game fix the bugs (with the help of QA testers), but that might not be a good option if those people are no longer available.

My tower, main laptop, and spare tower are all 1080p (1920 x 1080). I also have a tiny laptop that runs at 1366 x 768, but I never game with that

You have to get permission in writing if you want to avoid violations. I'd say it's pretty unlikely they'll go for it, considering that they have official games out for the IP. The punishment for moving forward with an unhappy party can be pretty severe, too. An unhappy employer might never work with a freelancer again, possibly terminating the contract early. An unhappy freelancer might deliver shoddy results that barely meet the definitions in the contract.
