Basically, you can abide by the conditions provided OR you can abide by CC-BY-SA. And unless I'm misunderstanding this, you are only able to choose CC-BY-SA in preference to the conditions provided if you aren't in Japan. I might be misunderstanding it though - the other way of interpreting it is that the CC license was made available to be more convenient for overseas users, not that it's necessarily restricted to overseas users. Besides, I'm not sure you can add that restriction to CC.

CC-BY-SA is generally more restrictive - the original conditions do not require attribution, nor do they require you to license derivative works under the same conditions. Under the original conditions, the only thing that is disallowed is repackaging the assets for a fee (like creating a pay-for-access archive site and uploading them, or selling them in a bundle on DLsite.) So if you want to do this for some reason, you have to use the CC-BY-SA license.

Sounds to me like the artist had no idea that putting a CC license on it meant that. I'd treat it like a NC license just because it's clearly the artists intent, even if it's not legally binding. BTW, my understanding of copyright law is that the court would be held in the artist's country, not the users. I could easy be wrong.

Actually, an NC license would mean you would not be able to use the assets in a commercial work at all, and the creator explicitly allows that, so an NC license was clearly _not_ intended.

There is no CC license that would cover the creator's intentions precisely, probably due to the difficulties, legally, in specifying what counts as a secondary distribution.

My apologies, I misread it. Man, that's not part of CC BY-SA? It should be. I wouldn't want my creative commons stuff sold like that either.

Thanks for the link and translation! I put a couple of the backgrounds in my RPG Maker game and it looks great.
