I wanted to use the Nagisa theme in a vn (Freely distributed), but I don't know if I can do it because of the copyright, does anyone know about this?

The person meant the VN they make will be freely distributed. Still, it's not allowed unless you can get permission from the creators, meaning it's impossible.
